SPS & TBT Database

Recently, the issues faced by Indian exporters in exporting products several merchandises due to sanitary and phytosanitary steps imposed by third countries has been increasing. For more transparency to the situation and improve the efforts to address these problems, the Government of India has set up an SPS and TBT Export Database. On the other hand, third countries sometimes implement unfair SPS steps in a way that the SPS measures harmfully affect the EU exports of agriculture and fishery foodstuffs.

  1. SPS Database

Sanitary and phytocentric (SPS) measures are sometimes important to secure the life or health of humans, animals, and plants, consisting of the security against threats posed by imported goods. Such steps must be depending on WTO SPS contracts, international values, suggestions or instructions may be relying on scientific standards.

  • SPS Notification Submission System: National Notification Administration now can use the SPS Notification Submission System (SPS NSS) to fill in and present SPS notifications online.
  • SPS Information Management System: It is a database of WTO information on SPS.
  • ePing SPS & TBT Notification Alert System: By enrolling in ePing, clients can get daily or weekly email notifications containing SPS/TBT notifications speaking about the products or markets of concern to them.

  1. TBT Database

The Technical Barriers to Trade (TBT) Agreement is intended to make sure that the process of evaluating technical rules, principles, and compliance is fair and does not formulate extra barriers to trade. Simultaneously it identifies the right of WTO members to take action to attain legal rule objectives such as the security of human health and protection or securing the environment. The TBT Agreement encourages participants to make easy trade and to conduct their activities in line with international standards. In the course of its transparency requirements, it also intends to form a viable business environment.

Following the instructions of the Department of Commerce, the Center for WTO research has launched web-based portals on TBT and SPS notifications to make easy this information. Currently, this feature is free for any "registered user" (containing both exporter and importer). As rates are being condensed gradually, it has been noted that non-tariff problems such as SPS and TBT steps are rising steadily. Sometimes they are made to secure the domestic industries in industrial economies. There are numerous notifications being released by WTO members and it is becoming increasingly hard for an exporter to follow all these developments.

The record gives a list of HS names. Based on this, a total of 12,820 TBT notifications have been submitted to the WTO as of December 2009, with product coverage of up to 66,000 products. Likewise, according to the Sanitary and Phytosanitary Measures (SPS) agreement, all WTO members must inform the WTO Secretariat of their rules and regulations, which in turn send it to other members for the same excise at that of TBT Agreement. A total of 8,792 notifications have been released for the same time, with product coverage approximately 72,000.
This database is used by the search/query command to obtain SPS and TBT measures on a country-specific, product-specific, or year-by-year basis. It will be updated on a bi-monthly basis. The portal has been working on a test base since January 1, 2009. The information that consists of these databases remained the same as that was spread by the members to the WTO under the requirement of SPS notification.

Export Inspection Council (Government of India)

To make the steady growth of India's export trade of India in the course of Quality Control and Inspection and related matters to it, the Export Inspection Council (EC) was established by the Government of India under Section 3 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963).

The EIC is a central government advisory structure, strengthened under the Act to:

  • Notify items that will be important to quality control and/or check before to export
  • Develop quality values for such notified items
  • Specialize in the kind of quality control and/or analysis to implement such items

In addition to its advisory function, the Export Inspection Council also practices the technical and administrative control over five Export Inspection Agencies (EIAs), one each in Chennai, Delhi, Kochi, Kolkata and Mumbai, created by the Department of Commerce, administration of India. Following section 7 of the Act to deal with the applying of several steps and strategies formed by the Export Inspection Council of India. Export Inspection Council, both automatically and with export inspection agencies, its subject organization provides services in the following fields:

  1. Quality assurance certificate of export goods through the launch of quality insurance system (quality control and self-certification in progress) in export units plus delivery wise inspection.
  2. Certification of food quality in order to export with the launch of a food protection management system in food controlling out units.
  3. Issuance of certificates of the source to exporters following several special tax schemes to export products.

Export Promotion Councils & Commodities Board

The Export Promotion Council, formed under the guidelines of Central Government, is a higher structure and is capable to form expert committees to help it in carrying out its duties. Consequently, the Council has formed an Executive Committee to consult on administrative matters and a Technical Committee to consult on technical issues. In addition, it has constituted some standing committees in special technical fields. Presently, there are 32 Export Promotion Councils & Commodities board under the administrative control of the Department of Commerce.
